Terms of Service

1. Scope

These terms govern your use of MyndFlare, operated by [Company Name] ("we"). By creating an account you agree to these terms and confirm you have read the Privacy Policy.

2. Account

• You must be at least 16 years old. At signup you confirm this explicitly.
• You are responsible for the confidentiality of your credentials.
• Passwords must be at least 10 characters. Choose a strong, unique password.
• Email verification is required before sign-in.
• One account per person.

3. Consent

At signup you confirm that you have read and accept this document and the Privacy Policy. We record the version of the documents you accepted, together with a timestamp, IP address, and user agent (GDPR Art. 7(1)). If we materially change these terms or the Privacy Policy, we will ask you to re-consent.

4. Acceptable Use

You may not:

• Submit unlawful, harmful, or deceptive content
• Circumvent rate limits, security measures, or the audit log
• Reverse engineer or probe the service
• Scrape the service in an automated way
• Share your credentials or resell access
• Use MyndFlare to generate content that violates an LLM provider's own usage policies

5. Content

You retain ownership of content you submit. You grant us a non-exclusive licence to process it to provide the service, including transmitting your prompts and attachments to the LLM provider you select. Responses from LLM providers are subject to those providers' own terms.

6. API Keys (BYOK)

If you provide your own LLM provider keys, you bear the full cost of API usage billed by that provider. We store keys encrypted with AES-256-GCM but accept no liability for their misuse by third parties or for charges incurred on your provider account.

7. Your Data

You can at any time:

• Export a full machine-readable copy of your account from Profile → Your Data → "Export all my data".
• Delete your account from Profile → Danger Zone → "Delete account". Deletion is permanent. A confirmation email is sent. Residual audit-log references are retained in anonymised form for security purposes (12 months).

8. Availability

We aim for high availability but make no uptime guarantees. Scheduled maintenance will be announced where possible. Third-party LLM provider outages are out of our control.

9. Liability

To the extent permitted by law, we are liable only for intent and gross negligence. LLM responses may be inaccurate, incomplete, or misleading — verify important information independently. Do not use MyndFlare as the sole source for medical, legal, financial, or other decisions with significant consequences.

10. Termination

You may delete your account at any time from Profile. We may suspend or terminate accounts that violate these terms or applicable law.

11. Changes

Changes to these terms are announced via email or in the app. Material changes trigger a re-consent prompt on next sign-in.

12. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Venue is [City], where permitted.
